What is a U Visa?

The U.S. Victims of Trafficking and Violence Protection Act and the Battered Immigrant Women Protection Act offer provisions for obtaining U visas for people who are the victims of crime or domestic abuse while visiting or living in the U.S. on a temporary visa and who help police or government officials investigate and prosecute the perpetrator.

A U visa grants crime victims the ability to live and work in the United States and may result in the dismissal of any case in immigration court filed against the victim. Family members included in the victim’s application are also eligible to apply for a work permit.

A U visa is valid for four years and may be extended if law-enforcement confirms that the U visa holder is required to remain in the United States to assist the investigation or prosecution of the crime. A Groveland attorney can help undocumented individuals get access to a U-visa after being a victim of a crime.

Qualifying for a U Visa

Qualifying for U nonimmigrant status requires meeting the following qualifications:

  • You must be a victim of a qualifying criminal act in the United States
  • You must have suffered physical injury or mental abuse as a result of the criminal act
  • You have information and are willing to assist the police in the investigation and prosecution of the crime
  • You are admissible to live in the United States under the requirements of the Immigration and Nationality Act (INC)

A seasoned Groveland undocumented crime victim attorney can help individuals discover if they meet the requirements for a U visa.

What is a T Visa?

The T visa was created to provide immigration relief to victims of severe forms of human trafficking. A T visa protects undocumented victims of crime from removal and gives them permission to live and work in the United States. T-visa applicants also have access to the same benefits as refugees, including cash assistance, food assistance, and job training.

As a knowledgeable Groveland undocumented crime victim attorney can explain, T visas are valid for four years. T-visa holders must maintain continual physical presence in the United States for three years or for the duration of a completed investigation or prosecution of the act of trafficking. T-visa holders must also maintain good moral character and cooperate with law enforcement.

Who is eligible for a T Visa?

You may be eligible for a T Visa if any of the following criteria are met:

  • You are a victim of a severe form of trafficking;
  • You are in the United States because of trafficking;
  • You are able to assist law enforcement in the investigation of the traffickers; and
  • You are able to prove that you will suffer hardship if removed from the United States.
